NOTE: The proposal came from the Proposal Meetings which you and your fellow members attended.
Changes/Additions to this proposal are not being accepted.
This is not what you will be voting on. This is what was presented to the Employer on your behalf on March 18, 2008. They have not responded at this time and we are expecting their proposal to be presented on April 1, 2008.
UFCW #1116 ARGA Grocery Proposals
ARTICLE 4
HOURS OF LABOR
1. Article 3: ADD:
ARGA Employer will grant card check neutrality in all their non-Union Stores.
2. Section 4.4: DELETE: minimum of four (4) hours.
CHANGE to a minimum of six (6) hours.
3. Section 4.5: DELETE: eighteen (18) hours per week.
CHANGE: to twenty four (24) hours per week.
ADD: Thirty (30) hours after five (5) years;
Thirty five (35) hours after ten (10) years.
ADD: Part-time Employees by seniority will be scheduled 39 hours if they request
4. Section 4.7 ADD: Contact Person(s)
Each store will designate a contact person(s) for employees notifying the employer when they are not available to work.
ARTICLE 4A
SUNDAY OPERATIONS
5. Section 4A.10: DELETE: last sentence:
"There shall be no Sunday Premium pay for any employee hired after 4/30/05."
Section 4A.10: DELETE: words:
“hired before 5/10/2005” (appears twice)
Section 4A.11: DELETE: First sentence in the first paragraph
Sunday operations shall be outside the regular work week for purposes of Health and Welfare contributions.
ARTICL 5
MISCELLANEOUS PROVISIONS
6. Section 5.2 DELETE: words:
“for Employees hired before 5/1/05. Overrate employee hired after April 30th, 2005 may be frozen at the higher starting rate and not progress on the wage scale until after 24 months of continuous service.”
7. NEW Section 5.3: Renumber the rest of Section 5
The Employer will forward all “Employee Corrective Action Notices” to the Union the same day the corrective action notice is given to the Employee. Those Employee Corrective Action Notices not received in a timely manner will void the corrective action taken by the Employer.
8. Section 5.19: DELETE:
“Food handling employees may stock and package meat products and there is no limitation on meat products which can be brought in and marketed in the store.”
ARTICLE 8
VACATIONS
9. Section 8.1: ADD:
Five (5) weeks of Vacation after twenty (20) years of service.
Six (6) weeks of Vacation after thirty (30) years of service.
10. Section 8.2.2: DELETE: the words:
“Hired before May 1st, 2005”
11. Section 8.2.2: DELETE the last sentence: "There shall be no accrued Vacation probation paid prior to two (2) years of service for employees hired after April 30th, 2005."
12. Section 8.3: ADD: "Five (5) weeks of Vacation after twenty (20) years of service."
DELETE last sentence: "Food handling employees hired after April 30th, 2005, shall be entitled to annual Vacation of one (1) week after the second (2nd) year, two (2) weeks after the fifth (5th) year, and three (3) weeks after the eighth (8th) year.

13. Section 8.4: DELETE: the last sentence: "Part-time non-food handling employees hired after April 30th, 2005, shall not be entitled to paid Vacation."

15. Section 8.8: DEFINE: Vacation Week
The vacation week shall be defined as Sunday through Sunday and with the Saturday off prior to the vacation if requested.
16. Section 8.8: CHANGE:
After March 1st, vacation dates shall be scheduled on a first come-first served basis without regard to seniority, NO BUMPING ALLOWED.
17. Section 88: CHANGE: Last Sentence:
If a vacation week which was chosen before March 1st becomes available after March 1st, that vacation time shall be selected in order of seniority.
18. Section 8.11 CHANGE:
Employees with two (2) or more weeks of vacation may take one (1) week of vacation in single day increments.
ARTICLE 9
HOLIDAYS
19. Section 9.1: Close on all Holidays.
DELETE second paragraph: Food Handling employees hired after May 1st, 2005, will receive two (2) personal days after five (5) years of employment.
CHANGE to: Food handling employees will receive two (2) personal days off after one (1) year of employment.
CHANGE: Birthday to a personal day
ADD: Easter Sunday as a Holiday
20. Section 9.1: DELETE: the words:
“Hired before May 1st, 2005” (appears 5 times)
21. Section 9.1: ADD: Employees with twenty (20) years or more of service will be granted three (3) personal days a year with pay.
22. Section 9.1: ADD: Employees with twenty five (25) years or more of service will be granted four (4) personal days a year with pay.
23. Section 9.4: DELETE the first paragraph: "Regularly scheduled Full-time and Part-time Food Handling employees hired after April 30th, 2005, working in any Holiday week who have worked for two (2) consecutive years for the Employer"
Section 9.4: DELETE second paragraph:
Part-time non food-handling employees hired after April 30th, 2005, shall not be entitled to Holiday pay. Holiday pay will not be included when calculating overtime, Part-time Full-time status, or Health Plan Part-time/Full-time contribution rates.
24. Section 9.6: DELETE: "and the basic work week shall be thirty two (32) hours for Full-time employees hired on or after May 1st, 2005,"

ARTICLE 10
SENIORITY
28. Section 10.3: DELETE:
Classified positions need not be maintained if there are reasonable grounds for eliminating the position or in cases of attrition, which shall include resignation, termination, retirement, transfer, or entire department elimination. Under no circumstances will the Employer have less than the three (3) classified positions outlined in Section 21.10B.
29. Section 10.5: DELETE:
“Restricted availability includes, by way of example and not limitation, requested days off (including school schedules), day care conflicts requiring scheduling limitations, and scheduling limitations relating to other employment”.
“Sunday hours shall not be included in determining whether a less senior employee is scheduled for more hours than a more senior employee”
30. Section 10.7: CHANGE: First sentence
When an opening occurs for full- time and part-time positions such positions will be posted. Part-time employees shall be given the first opportunity to fill such open positions.
Supervisory and full-time positions shall be offered equally to female applicants.
31. CHANGE: Second paragraph change to read:
He/she shall receive the top part-time or the starting full-time rate, which ever is higher.
ARTICLE 14
GREIVANCE AND ARBITRATION PROCEDURE
32. Section 14.1I:CHANGE: WORDS:

ARTICLE 15
HEALTH AND WELFARE/PENSION
33. Section 15.1: DELETE:
The parties agree that in the event UFCW Local 1116 is merged, consolidated, affiliated, or otherwise combined with any other local Union and/or in the event the Health & Welfare Fund is merged, consolidated, affiliated, or otherwise combined with any Health Plan, the Employer may elect to terminate participation in the Health & Welfare Fund, so long as the Employer provides replacement medical coverage.
34. Section 15.2: INCREASE: Full-time contributions to applicable rates for the term of the Contract.
Section 15.2: DELETE: the third paragraph referencing the 25% co-pay for Full-time H & W.
35. Section 15.3: INCREASE: Part-time contributions to applicable rates for the term of the Contract.
DELETE: the following: "and Part-time employees hired after April 30th, 2005, shall be eligible for Health Plan Benefits commencing with the first day of the month following the date on which the Employer has made six (6) monthly contributions on behalf of the employee."
36. Section 15.6: INCREASE: the Pension contribution by $0.15 (fifteen) cents per hour, in each year of the Contract.
DELETE: language in Contract on: Employers hired after May 1st, 2005, whose Pension contribution is sixty ($0.60) cents per hour with five (5) years or less.
37. New PENSION Section:
All ARGA Employers will offer a 401K for their Employees
ARTICLE 18
FUNERAL LEAVE
38. Section 18.1: ADD
Grand children, significant other, step parents grand parents, children, brothers, and sisters
ARTICLE 21
RATE OF PAY
39. Section 21.3: DELETE: all reference to: (hired before May 1st, 2005) (3 times.)
Section 21.3: INCREASE: the night premium to fifty cents ($0.50) per hour.
40. Section 21.9: Summer Help: DELETE the entire Section.
41. DELETE: The number four (4) in the Letter of Agreement on Page 36
42. ADD: A PPIC will be appointed and paid the PPIC premium when an employee is covering for the Department Manager or Supervisor when the Mgr or Supervisor is off work do to illness, injury, personal holiday, day off or vacation day or days.
ADDENDUM A
43. Convert all pay scales to hours worked.
CHANGE: Food Handling Department Handler to Food Handling Department Head and Assistant Store Manager
DELETE: Full-time Food Handling Employees hired on or after 5/1/05. (Wage Scale)
DELETE: Part-time Food Handling Employees hired on or after 5/1/05. (Wage Scale)
CHANGE: Full-time Bakery/Deli wage scale.
NO BONUSES
ADD: Woodland Piggly Wiggly covered by this Agreement
ADD: Pharmacist Tech and Certified Pharmacist Tech to Pay Scale
DELETE: Deli and Bakery Managers Scale and change to Food Handling Department Head wage scale.
CHANGE: Decorators pay scale.
44. Five per cent (5%) Wage INCREASE for all rates and all brackets
45. Employees that were promoted from Part-time to Full-time are not to be classified as new Employees retro active to May 1st, 2005.
46. All “Letters of Understanding” or “Letters of Agreement” will be reviewed and add to the body of the contract or deleted.
47. The cost of printing the ARGA contracts will be divided equally between the ARGA Employers and UFCW Local #1116.
48. The cost of renting the meeting rooms will be divided equally between the ARGA Employers and UFCW Local #1116.
49. Baggers and Utility employees will receive the same benefits as the other part-time employees, including but not limited to:
