NOTE: The proposal came from the Proposal Meetings which you and your fellow members attended.
Changes/Additions to this proposal are not being accepted.
This is not what you will be voting on. This is what was presented to the Employer on your behalf on March 18, 2008. They have not responded at this time and we are expecting their proposal to be presented on April 1, 2008.
UFCW #1116 ARGA MEAT PROPOSALS
ARTICLE 1
UNION SHOP
1. ADD:
ARGA Employer will grant card check neutrality in all their non-Union Stores.
ARTICLE 2
HOURS & OVERTIME
2. Section 2.1: DELETE in the First paragraph:
All references hired before May 1st, 2005
Section 2.1: DELETE the third paragraph:
Employees hired after April 30th, 2005, will not receive the Good Friday pay, Christmas Eve pay, Sunday Premium pay, Holiday Premium pay, or the Night Premium pay.
3. Section 2.10 CHANGE: language to read:
No employee shall be required to work two (2) consecutive Sundays
ARTICLE 3
MISCELLANEOUS PROVISIONS
4. Section 3.6 CHANGES:
When an opening occurs for full- time and part-time positions such positions will be posted. Part-time employees shall be given the first opportunity to fill such open positions.
Supervisory and full-time positions shall be offered equally to female applicants.
ARTICLE 7
JOB DESCRIPTION
5. ADD: POSITION
Assistant Meat Department Manager and appropriate wage.
ARTICLE 8
VACATIONS
6. Section 8.1: ADD: "Five (5) weeks after twenty (20) years of service.
7. Section 8.1: ADD: Six (6) weeks after thirty (30) years of service.
8. Section 8.1: DETETE in the first paragraph:
Hired on or before April 30th, 2005
Section 8.1: DELETE the second paragraph:
Employees hired after April 30th, 2005, shall be entitled to annual Vacation of one (1) week after the second (2nd) year; two (2) weeks after the fifth (5th) year; and three (3) weeks after the eighth (8th) year.
9. Section 8.2: DELETE :
Hired on or before April 30th, 2005
10. Section 8.3: DELETE: In first, second, third, and fourth paragraph:

Section 8.3: DELETE: the last sentence of the first paragraph:
There shall be no accrued Vacation pro-ration prior to two (2) years of service for Part-time employees hired after April 30th, 2005.
11. Section 8.3: DELETE: the last sentence of the second paragraph:
Part-time Non-Food Handling employees hired after April 30th, 2005, shall not be entitled to paid Vacation.
11. Section 8.6: CHANGE:
After March 1st, vacation dates shall be scheduled on a first come-first served basis without regard to seniority, NO BUMPING ALLOWED.
12. Section 8.6: CHANGE: Last Sentence:
If a vacation week which was chosen before March 1st becomes available after March 1st, that vacation time shall be selected in order of seniority.
ARTICLE 9
HOLIDAYS
13. Section 9.1: DELETE: in the first paragraph:

“Employees hired after April 30th, 2005 will receive two (2) personal days after five (5) years of employment.”

18. Section 9.4: DELETE the third paragraph:
“Part-time Non-Food Handling employees hired after April 30th, 2005, shall not be entitled to Holiday Pay. Holiday Pay will not be included when calculating overtime, Part-time/Full-time status, or Health Plan Part-time/Full-time contribution rates."
19. Section 9.6: DELETE: in the first paragraph:
“for full time Employees hired before may 1st, 2005 and the basic work week shall be 32 hours for full time Employees hired on or after May 1st, 2005” ( appears twice)

21. Section 11.2b: DELETE: Second Paragraph
Section 11.2b: DELETE: in fourth paragraph the words:
“This provision shall also apply to the weeks of and weeks prior to holidays listed in this agreement.”
Section 11.2 G: CHANGE: letter to C and Delete the words:
“, or as a result of the Employer hiring vacation replacement Employees.
ARTICLE 14
ARBITRATION

ARTICLE 16
HEALTH AND WELFARE/PENSION
23. Section 16.1: DELETE the second paragraph:
The parties agree that in the event UFCW Local 1116 is merged, consolidated, affiliated, or otherwise combined with any other local Union and/or in the event the Health & Welfare Fund is merged, consolidated, affiliated, or otherwise combined with any Health Plan, the Employer may elect to terminate participation in the Health & Welfare Fund, so long as the Employer provides replacement medical coverage.
24. Section 16.2A: INCREASE:
The Full-time contribution to applicable rates for the term of the Contract.
25. Section 16.2B: DELETE the third paragraph referencing the 25% co-pay for Full-time H & W.
26. Section 16.2B: INCREASE:
The Part-time contributions to applicable rates of the term of the Contract.
27. Section 16.2B: DELETE the following from the fourth paragraph:
Employees and Part-time employees hired after April 30th, 2005, shall be eligible for Health Plan Benefits commencing with the first day of the month following the date on which the Employer has made six (6) monthly contributions on behalf of the employee.
28. Section 16.2B: DELETE the sixth paragraph:
Part-time employees hired after April 30th, 2005, shall be eligible for Health Plan Benefits commencing with the first day of the month following the date on which the Employer has made six (6) monthly contributions on behalf of the employee.
29. Section 16.6A: INCREASE the Pension to applicable rates per hour. (Same as
Grocery)
30. Section 16.6B: DELETE the second paragraph:
Effective the date of this Agreement, the Employer agrees to contribute sixty cents ($0.60) per hour to said Pension Fund for each hour worked by each Full-time and Part-time employee (exclusive of Part-time Non-Food Handling employees) hired after April 30th, 2005.

ARTICLE 17
JURY DUTY, ACCIDENT, LEAVE OF ABSENCE, MATERNITY
& FUNERAL LEAVE

WAGE RATES
37. A Wage INCREASE of 5% on all rates all brackets.
38. DELETE: Part-time Meat Handlers hired after 4/30/05.
39. CHANGE: Meatcutter Apprenticeships will be two and one half (2 ½) years, at which time the employee becomes a Journeyman Meatcutter.
40. DELETE: the words hired before 5/1/2005
41. NO bonuses for employees.
42. Employees that are promoted from Part-time to Full-time are not to be classified as a new employee retroactive to May 1st, 2005.
The Union reserves the right to add to, subtract from, or modify these proposals at any time during bargaining.
